Ofcom additional income added to Department's 2015 budget and carry forward for use of Jersey Aircraft Registry Online Registration

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Request to use additional Ofcom income in Economic Development (EDD) and change of use of the carry forward budget for the Jersey Aircraft Registry online registration.

 

Officer recommendation:  The Minister is recommended to request the use of additional unanticipated income of £248,282 Ofcom income. The income is to be added to the Department’s approved budget and recognised as income for 2015. The Minister is recommended to request the change of use of carry forward budget of £110,000 for the Jersey Aircraft Registry online registration.

Reason(s) for Decision:  Under Article 19(1) of the Public Finances (Jersey) Law 2005 the Minister for Treasury and Resources can authorise a States funded body to withdraw from the consolidated fund during a year an amount not exceeding the likely excess of income over the amount approved in that year’s revenue allocation.

 

Article 18(3A) of the Public Finances (Jersey) Law 2005 states the Minister may approve the withdrawal from the consolidated fund, after the end of the relevant financial year, of all or part of the amount appropriated by a revenue head of expenditure.

Resource Implications:  Recognition of £248,282 income in 2015. The income is to be added to the approved budget for 2015 together with the change of use of the carry forward budget in the sum of £110,000 for the Jersey Aircraft Registry online registration to be used for onward additional grant to Digital Jersey Limited.

Action required:  EDD Senior Management Accountant to inform the Head of Decision Support that this decision has been approved.

ADDITIONAL OFCOM INCOME and change of use of carry forward budget

 

 

  1. Purpose of Report

 

To enable the Minister to request that unanticipated income of £248,282 from Ofcom to be added to the Economic Development Department’s (EDD) approved net revenue expenditure and recognised as income for 2015. The Minister is recommended to request the change of use of carry forward budget of £110,000 for the Jersey Aircraft Registry online registration.

 

2.   Background

 

EDD has recently received funding from Ofcom in respect of Wireless Telegraphy Licence fees.

 

Income of approximately £300,000 was expected from Wireless Telegraphy Licence Fees each year (although the exact sum was not certain) and this has been included in the Medium Term Financial Plan 2013-2015.

 

Fees are collected by Ofcom on behalf of the States of Jersey, under authority of various pieces of legislation, most notably the Communications (Jersey) Order 2003, SI 2003/3197, arts 6, 7, Sch 2, para 91 (as amended by SI 2006/3324, art 4(2), Sch 2, Pt 2) and SI 2003/3197, arts 1(3)–(5), 2.

 

EDD received £548,282 on 2nd April 2015 from Wireless Telegraphy Licence Fees. This decision is requesting that the T&R Minister agrees that £248,282 should be added to the Department’s approved revenue expenditure and recognised as income for 2015.

 

 

3.   Proposed use of the funding by EDD

 

The Department allocated £825,000 grant funding for Digital Jersey Limited in the 2015 Business Plan and has agreed to pay an additional one off grant of £400,000 in 2015 subject to the approval by the Minister for Treasury and Resources to use the additional Ofcom income of £248,282 and change the use of £110,000 carry forward budget for the Jersey Aircraft Registry online registration which is now due to commence slightly later than anticipated.

 

The balance will be taken from a recharge to the Jersey Innovation Fund of £41,718 for part of the costs incurred for the administration of the Fund by the department.

 

There will be no further funding for Digital Jersey Limited in 2015 and funding for 2016 and beyond will be addressed in the next MTFP.
