St. Martin's Village Green car park - introduction of a maximum stay of 12 hours in 24 hour period

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Introduction of maximum stay period of 12 hours in any continuous 24 hour period at St Martin’s Village Green car park

Decision(s): The Minister agreed to amend the Road Traffic (Public Parking Places) (Jersey) Order 2006 and undertook to request Officers to instruct the Law Draftsman to prepare the necessary Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 for subsequent submission to the Minister.

Reason(s) for Decision: At the request of the Connétable of St Martin make St Martin’s Village Green Car Park subject to a maximum stay period of 12 hours in any 24 hours.

Resource Implications: Transport and Technical Services Officers and Law Draftsman time.

Action Required: Officers to instruct the Law Draftsman to prepare an Amendment for subsequent submission to the Minister.

TRANSPORT AND TECHNICAL SERVICES  

AMENDMENT TO ROAD TRAFFIC (PUBLIC PARKING PLACES) (JERSEY) ORDER 2006  

Purpose of the Report  

To introduce a maximum stay period of 12 hours in any continuous 24 hour period at St Martin’s Village Green Car Park in St Martin. 

Background  

The Connétable of St Martin has requested that St Martin’s Village Green Car Park be included in the Road Traffic (Public Parking Places) (Jersey) Order 2006 with a maximum stay period of 12 hours in any continuous 24 hour period to enable policing of the area to take place.  

The request to include this car park with a maximum stay period will help to deter long term parking and will enable users of the facilities nearby to park. The area has been found to be abused with long term parking when checked by Parish Officials. 

Discussion  

Officers support the introduction of the St Martin’s Village Green Car Park with a maximum 12 hour in any continuous 24 hour period stay. The policing and enforcement of this to be carried out solely by the Parish of St Martin. 

Recommendations  

The Minister is recommended to approve the request from the Connétable of St Martin and to request Officers to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to incorporate this.
