Regulation of Undertakings and Development: Budget Transfer from Economic Development to Chief Minister's Department

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Budget Transfer: Regulation of Undertakings and Developments budget and 6 FTEs from the Economic Development Department to the Chief Minister’s Department with effect from 1st August 2011.

Decision(s): The Chief Minister approved the transfer of the part year budget and 6 FTEs with effect from 1st August 2011 and the full year budget from the Economic Development Department to the Chief Minister’s Department with effect from 2012, including the CSR proposals for 2012 and 2013.

Reason(s) for Decision: The States has now approved a new Law (P.37/2011) to replace the Housing (Jersey) Law, 1949 and the Regulation of Undertakings and Development (Jersey) Law.

 

To facilitate the management of resources during the transitional phase in the lead up to the new Law, it is proposed that the Regulation of Undertakings budget now also be transferred to the Chief Minister’s Department. In this way, the Population Office will have a single budget under the Chief Minister’s Department.

 

Article 15(1)(a) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

Under Financial Direction 3.6 “Variations to Heads of Expenditure”, all transfers between heads of expenditure arising from the transfer of responsibility and administration of a service require both the relevant ministers party to the transfer to agree the associated financial and manpower transfers and to notify such transfers to the Treasurer of the States. 

 

Delegation 1.3 (October 2010) delegates authority for non-contentious transfers between expenditure heads of up to £1,000,000 to the Treasurer of the States.

Resource Implications: The budget and 6 FTEs for the administration of the Regulation of Undertakings and Developments (Jersey) Law, 1973 will be transferred from the Economic Development Department to the Chief Minister’s Department. The resource implications are identified in the attached report.
