Budget Transfer: Regulation of Undertakings and Developments budget from the Economic Development Department to the Chief Minister’s Department
- Purpose of Report
To transfer the budget and 6 FTEs for the administration of the Regulation of Undertakings and Developments (Jersey) Law, 1973, from the Economic Development Department to the Chief Minister’s Department with effect from 1 August 2011.
- Background
In 2005, the Assembly agreed in principle to a new approach to managing migration and its associated demands on housing and work.
As part of this, it proposed a single Population Office to manage the Housing (Jersey) Law, 1949 and the Regulation of Undertakings and Developments (Jersey) Law, 1973 and to develop a new Law. The States also agreed that migration policies should ultimately be managed by the Chief Minister’s Department.
Accordingly, in 2006, the budget for the Housing Law was transferred from the Housing Department to the Chief Minister’s Department. This fitted with the Housing Department focusing on its social housing stock and tenants, as clearly delineated from the activities of the Population Office.
The Regulation of Undertakings budget however, was not transferred from the Economic Development Department at this time, recognising the strong links and synergies that existed between the Population Office and the Economic Development Department, and given that some uncertainties existed around budget levels.
- Subject matter
The States have now approved a new Law to replace the Housing (Jersey) Law, 1949 and the Regulation of Undertakings and Developments (Jersey) Law. It is proposed that the new Law be effective in August, 2012. The new Law will be the responsibility of the Chief Minister.
To facilitate the management of resources during the transitional phase in the lead up to the new Law, it is proposed that the Regulation of Undertakings budget now also be transferred to the Chief Minister’s Department. In this way, the Population Office will have a single budget under the Chief Minister’s Department. This will support good financial management and reporting, for example, as Officers work across both existing Laws and in development of the new Law.
The allocated budget to be transferred are:
- 1st August – 31st December 2011, £160,200;
- 2012, £373,300 and
- 2013, £354,800 recurring
The above net budget includes the following CSR Savings:
- 2012, £2,000 – cessation of support staff
- 2013, £2,000 – cessation of support staff and
CSR User Pays
- 2012, £12,000 – modest charge for the Regulation of Undertakings process
- 2013, £12,000 – modest charge for the Regulation of Undertakings process
- Recommendation
It is recommended that the budget and 6 FTEs for the administration of the Regulation of Undertakings and Developments (Jersey) Law, 1973, be transferred from the Economic Development Department to the Chief Minister’s Department.
- Reason for Decision
Under Financial Direction 3.6 “Variations to Heads of Expenditure”, all transfers between heads of expenditure arising from the transfer of responsibility and administration of a service require both the relevant ministers party to the transfer to agree the associated financial and manpower transfers and to notify such transfers to the Treasurer of the States.
