Car Parking: 2018 Fees and Charges Increase: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Jersey Car Parking – 2018 Increases to Fees and Charges

Decision(s):

The Minister approved the increases to Jersey Car Parking fees and charges for 2018 as set out in the attached report.

Reason(s) for Decision:

To enable Jersey Car Parking to increase its fees and charges in 2018 to allow Jersey Car Parking to maintain the standard of car parks over a 25 year period as highlighted in the original report issued by PricewaterhouseCoopers and subsequently updated by BDO Alto Limited (the “Car Parks model”) and to pay Parish Rates in respect of public car parks, introduced as a result of the proposal of the Connetable of St Helier as amended by the Comite des Connetables in the 2018 Budget debate.

Resource Implications:

The additional income as a result of the 2018 increases to parking fees and charges are identified as per the 2016 – 2019 Medium Term Financial Plan, with the exception of the impact of parish rates, which was agreed by the States during the 2018 budget debate in November.

 

Cost of advertising increases to fees and charges in the Jersey Evening Post.

Action required:

The Director of Transport Policy to advertise the fees and charges for 2018 in due course and to request the Law Draftsman to make the necessary changes to the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2010.  The Director of Transport Policy to also liaise with the two electronic payment providers (for the PayByPhone and ANPR systems) to arrange for charges to be increased on the specified dates.
