Wood Pellet Stoves: National Fire Protection Association (NFPA) Standard 211 - Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Approval of the National Fire Protection Association (NFPA) Standard 211 for the installation of mechanically vented Wood Pellet Stoves in dwellings as an alternative to the  Ministers approved Technical Guidance Document (TGD) Part 3 (2011 Edition).

Decision(s):

  1. The Minister decided to accept wood pellet stoves as a special class of appliance and permit the installation of mechanically vented wood pellet stoves in dwelling accommodation with a flue vent that does not accord with the guidance given in the TGD 3, but which terminates in accordance with the recommendations given in the NFPA standard 211, subject to the following conditions;
    1. A test report is provided that confirms the pellet stove conforms to BS EN 14785:2006 – residential space heating appliances fired by wood pellets – requirements and test methods.
    2. Any flue system which does not follow all relevant recommendations given in the TGD 3 is independently tested by a Laboratory which holds United Kingdom Accreditation Service (UKAS), or equivalent, accreditation for undertaking such tests, and certified by that Laboratory as being adequate for the proposed appliance and that the completed installation will meet all relevant requirements of the building bye-laws (Jersey) as amended. 
    3. The work is to be undertaken by a person registered under one of the Minister’s approved schemes for the installation of solid fuel burning combustion appliances.
  2. The Minister instructed the building control director to research options for extending the Minister’s approved schemes for certifiable building work, so as to include schemes specifically aimed at ensuring competency of persons specialising in the installation of wood pellet stoves. In particular, the National Fireplace Institute examination for Pellet Certified Specialists. 

 

 

Reason(s) for Decision: To facilitate the installation of wood burning pellet stoves without a conventional chimney.

Resource Implications:  Officer time.

Action required:  

  1. Change application guidance for the householders and installers to highlight the alternative options available for the installation of mechanically vented pellet stoves.
  2. Research options for extending approved schemes for certifiable building work and produce report for Minister’s consideration.
