Delegated Authority Decisions.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Delegated Authority Decisions for Noting by Minister 

Decision(s):

The Minister noted the decisions taken by officers under delegated powers in the period from 16 January 2008 to 14 February 2008. 

Minden Place Car Park, St Helier - 9 Year Site Licence Agreement between the Public and Jersey Airtel Limited. 

Rozel Pier, St Martin - 9 Year Site Licence Agreement between the Public and Jersey Airtel Limited 

Unit Nos 117, Central Market, St Helier - Lease Assignment from Mr Graeme Harold Harris and Mrs Anne Christine Harris nee Behan to Mr Jose Avelino de Olim Freire for the remaining term of the 9 year lease which commenced on 16 April 2006. 

Channel Island Welding Limited, Southern Warehouse, La Collette - Proposed Assignment of Existing Sub-Lease between Channel Islands Welding Limited and B G Romeril and Company Limited to First Tower Carpet Company Limited. 

Le Port Car Park, St Ouen - Renewal of lease for mobile van site to Mr Albert John du Feu for a further 3 years at an annual rental of £9,000.00 per annum.  

Fields 34 and 37, Queens Valley, Grouville -  Renewal of lease to Mr David John Le Cornu  for a period of one year with effect from 1 January 2008 at a rental of £1,900.00 per annum. 

 
 
 
Reason(s) for Decision: 

To note the officer decisions in respect of the site licence agreements, lease assignments and renewal of leases as detailed above made under delegated powers in accordance with the Minister’s Decision of the 20 February 2006.  

Resource Implications:  There are no resource implications other than those set out in the decisions.

Action required:

The Director of Property Holdings will advise the relevant departments of the Minister’s decisions.
