Fisherman's Cottage, Mount Bingham, St. Helier - listed as SSI

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment:

  1. Confirmed his intention to List Fishermen’s Cottage, Mount Bingham, St. Helier, as defined in the attached schedule, as a Site of Special Interest under the provisions of Article 51(2)(b) Planning and Building (Jersey) Law 2002 by virtue of its special interest as described in the same schedule.
  2. Approved and authorised the serving of the Intention to List Notice in accord with the requirements of the Law.

Reason(s) for Decision:

1.      The special interest of Fishermen’s Cottage, Mount Bingham, St. Helier as defined and assessed relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) law 2002.

2.      It accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets.

Relevant interests of the site (also see schedule)

 

The building known as the Fishermen’s Cottage was first registered in 1992 and was confirmed as a BLI by the Jersey Building Heritage Sub-Committee in 2002. An archaeological appraisal, undertaken by Dr Warwick Rodwell on behalf of the National Trust for Jersey in May 2007, has shown that the significance of the building merits its consideration as an SSI.     

The building is single-storied with gables and granite chimneystacks to either end. It has a simple interior but with its original features surviving - most notably two corbelled granite fireplaces and an oak roof structure. Dr Rodwell’s report concludes that the cottage dates to the late 17th century and was originally a pair of semi-detached dwellings - the only known example of this type of building surviving in Jersey.

 

Advice received (MRLAG or others)

 

An archaeological appraisal carried out by Dr Warwick Rodwell concludes that the Fishermen’s Cottage is a rare surviving example of an intact late 17th century single-storey building and is a significant component of Jersey’s built heritage.

 

MRLAG discussed the building at its meeting on 12 November. Members unanimously advised that the Fishermen’s Cottage should be re-graded on the Register to a pSSI and subsequently listed as an SSI. 

 

JHT recommendation

 

The Fishermen’s Cottage is of special historical, architectural and archaeological interest and should be listed as a Site of Special Interest.   

 

It is recommended that the Minister for Planning and Environment:

 

·        Re-grade the Fishermen’s Cottage on the Historic Buildings Register to a pSSI;

  Approve the serving of the Intention to List Notice in accord with the requirements of the Law.

 

Justification relating to criteria

 

The registration of the Fishermen’s Cottage as a pSSI is in accordance with the published principles for selection as follows:

 

·        The special interest of the building extends substantially to its authentic fabric, plan form and interior features.

  The building is of special interest for its architectural design and use of materials, and the site illustrates a significant aspect of Jersey’s history.

  The cottage is an unusual building type.

  There is archaeological significance of the fabric of the cottage, given that it originated in the 17th century.

 

The special interest of the Fishermen’s Cottage, as defined and assessed relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002
