Sea Fisheries (Licensing of Fishing Boats) (Amendment No. 5) (Jersey) Regulations 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Sea Fisheries (Licensing of Fishing Boats) (Amendment No. 5) (Jersey) Regulations 201- (Draft - 28 March 2011)

Purpose of the Report

.

For the Minister to approve the draft Sea Fisheries (Licensing of Fishing Boats) (Amendment No 5) (Jersey) Regulations 20__ for lodging.

 

Background

 

The States Business Plan for 2011 approved the introduction of fees in respect of annually issued fishing permits under the CSR user pays principle.

 

The ability for the Minister to set fees for fishing licences and permits is contained in the Sea Fisheries (Licensing of Fishing Boats) (Jersey) Regulations 2003; however those regulations specifically exclude the ability to charge where a licence is reissued in respect of the same person in respect of the same fishing boat. This effectively prevents the charging of a fee for the renewal of licences/permits.

 

On 1st December 2010 the Minister gave approval for law drafting to commence to modify the regulations to allow for the charging of a fee for the renewal of licences.  Drafting work is now complete and the draft amendment regulations are ready for lodging.

 

Discussion

 

In strict terms fishing vessel licences or permits are not renewed, but on change of details or at the end of specific time periods, new licences or permits are issued.  When licensing was first introduced it was deemed to be inappropriate to charge for either a straightforward renewal of a licence or permit or the issue of a replacement licence or permit required as a result of the holder changing address or other such details.  It was for these reasons that the Regulations were drafted to preclude the ability to charge fees in such circumstances.

 

By removing these constraints the Minister will be able to prescribe renewal charges by Order. Where the Minister deems it to be unnecessary to charge a fee (perhaps for example the issue of a replacement licence resulting from a change of address of the holder) then the order will not specify a fee.

 

Fishing vessel licences are next due for routine renewal on 1st January 2013 and so the approval of the draft regulations will have no immediate impact on the fishing industry.  A Ministerial order setting renewal fees will need to be put in place during 2012.


Recommendation

 

The Minister approves the draft Sea Fisheries (Licensing of Fishing Boats) (Amendment No 5)(Jersey) Regulations 20__ and instructs the Greffe to lodge them for debate.
