Jersey Heritage Trust: Refreshment and Refurbishment Fund: Budget Transfer

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Shortfall in Annual Refreshment and Refurbishment Fund for Jersey Heritage Trust (JHT).

Decision(s): 

The Minister accepted the transfer of £315,000 from Central Contingency (one-off) to ESC for JHT annual capital requirements in line with the Refreshment and Refurbishment Fund.

 

Reason(s) for Decision:  The requirement for the funding for capital for Jersey Heritage was identified by the Comptroller and Auditor General and independent consultants engaged by Economic Development Department.  The need for the fund is to carry out a rolling programme of improvements.  In the MTFP this was funded by the Summer Lottery but it is anticipated that this will not be enough and funding is required now so that works can commence.

Resource Implications:  Transfer of £315,000 to ESC for JHT

Action required: Request for Treasury Minister to approve and then the Finance Director and Treasury to implement the transfer.

SHORTFALL IN ANNUAL REFRESHMENT AND REFURBISHMENT FUND FOR JERSEY HERITAGE TRUST

 

  1. Purpose of Report

 

To request the Minister for Treasury and Resources to approve a budget transfer of £315,000 from Central Contingency (one-off) to the Education Sport and Culture Department (ESC) Revenue Head of Expenditure, the funding for which was endorsed by the Council of Ministers in comments to P.75/2010.

 

 

  1. Background

The need for Capital funding for Heritage was identified in a report by the Comptroller and Auditor General and also by consultants engaged by the Economic Development Department.

 

In the MTFP 2013-2015 new bids for growth, bid 39 states that the Channel Islands Lottery was unlikely to meet its targets and therefore, in 2012, the £315,000 was added to the ESC budget as a ‘one off’ pending lottery funding.  Indications that this fund could be supported by the Summer Lottery proceeds have not been fulfilled and whilst JHT is exploring an alternative source with the Treasury, no additional funding is currently available.  ESC, therefore, recognises the balance on the fund in 2013 as a current funding requirement.

 

  • Commitment was made to JHT of £465,000 pa
  • ESC only has £150,000 balance
  • JHT is not on the list of benefactors for the new Summer Lottery
  • JHT needs money to commence work
  • JHT have submitted an annual application to ESC

 

 

  1. Recommendation

 

The Minister is recommended to request the Minister for T&R to approve a budget transfer of £315,000 from Central Contingency (one-off) to the Education Sport and Culture Department (ESC) Revenue Head of Expenditure, the funding for which was agreed by the Council of Ministers in comments to P.75/2010 and again supported in the MTFP 2013-2015.

 

 

  1. Reasons for Decision

 

JHT is required to set out a rolling programme of improvements to sites or projects to encourage access to those sites, the purpose of which is to ensure they continue to attract the public, whether residents or visitors, in order to sustain the business of the Trust.  The specific uses to which the fund is put each year are set out in an annual application to the ESC Minister and included in the Hersey Heritage Business Plan.  This year, for example, work includes improvements at La Hogue Bie, which will enable greater emphasis to be put on the Ice Age project, and also updating the display of the Occupation Tapestry.
