Road Traffic (St. Peter) (Jersey) Order 1992: Amendment: Law Drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST PETER) (JERSEY) ORDER 1992 - AMENDMENT

 

 

Purpose of the Report

 

To amend the Road Traffic (St Peter) (Jersey) Order 1992.

 

 

Background

 

A request has been received from the Connétable of St Peter to amend the Road Traffic (St Peter) (Jersey) Order 1992.

 

 

Discussion

 

The following are the additions requested by the Connétable of St Peter:

 

La Rue du Bocage: a yellow prohibition of parking line has been painted on the western side from the junction with La Rue de L’Eglise to the northern boundary of the property known as La Garenne. This has been as a result of a number of complaints received by the Honorary Police in respect of vehicles being left on the road causing problems for other road users and residents. This would be added to Schedule 2 - Prohibition of Waiting in the Order. La Rue du Bocage is administered by the Parish of St Peter so the cost of road marking has been met by the Parish.

 

La Route du Manoir: a yellow prohibition of parking line has been painted on the southern side from the junction with La Route de Beaumont but has not been scheduled. The Connétable has requested this be extended so it is applied to both sides of La Route du Manoir for a distance of 55 yards east from the junction with La Route de Beaumont on the north side and 51 yards east from the junction with La Route de Beaumont on the south side. The request is in response to a number of complaints received about parking in this area causing difficulties for other road users. This would be added to Schedule 2 – Prohibition of Waiting in the Order. La Route du Manoir is administered by Infrastructure, Housing and Environment so road marking costs will be the responsibility of the Department.

 

La Rue du Saut Falluet; a yellow prohibition of parking line has been painted on the northern side of the road but has never been scheduled. This was as a result of a number of complaints of parked vehicles causing difficulties for other road users as La Rue du Saut Falluet is a narrow road with few places to allow traffic to pass safely. The Connétable has requested this be extended to the full length of La Rue du Saut Falluet on both sides of the road between its junction with La Rue de la Commune at the western end and La Rue des Landes at the eastern end. This would be added to Schedule 2 – Prohibition of Waiting in the Order. La Rue du Saut Falluet is administered by the Parish of St Peter so the cost of road marking will be met by the Parish.

 

La Route de L’Hermite; to add a prohibition of parking on both sides for a distance of 145 yards in a northerly direction from its junction with La Rue Rose. La Rue Rose is already scheduled with a prohibition of parking on both sides for its entire length in order to enforce Airport security as this borders the Airport boundary fencing. The continuation of the prohibition of waiting onto La Route de L’Hermite will further enforce this as the length to be scheduled also borders the Airport boundary fence. This would be added to Schedule 2 – Prohibition of Waiting in the Order.

 

 

 

 

 

Conclusion

 

The Amendment will formalise the request from the Connétable of St Peter to add a number of areas of prohibition of parking to the Road Traffic (St Peter) (Jersey) Order 1992.

 

 

Recommendations

 

The Minister is recommended to instruct Officers to issue Law Drafting instructions to amend the Road Traffic (St Peter) (Jersey) Order 1992.

To introduce a number of areas of prohibition of waiting in St Peter following a request from the Connétable of St Peter.
