AMENDMENT REQUEST
Purpose of the Report
To amend the Road Traffic (St Helier) (Jersey) Order 1996 to make permanent the temporary amendments made under Article 68 of the Road Traffic Law and to make corrections to some articles where errors have been noticed.
Background
Temporary amendments under Article 68 of the Road Traffic (Jersey) Law 1956
Between September 2011 and July 2012 five amendments to the Road Traffic (St Helier) (Jersey) Order 1996 were made using powers granted under Article 68 of the Road Traffic Law. These Amendments are temporary and after 12 months must be formalised into the Parish Road Traffic Order if they are to become permanent. T TS officers and Parish officials are now satisfied that the temporary amendments are still appropriate and therefore wish these changes to be included in the Parish Road Traffic Order.
Road Traffic (St Helier) (Jersey) Order 1996 Correction
The Parish has informed the Department that the road from English Harbour to the bottom of Mount Bingham is named “Le Quai aux Marchands”. There is currently no mention of this road in the Parish Road Traffic Order despite significant lengths of this road being painted with yellow lines prohibiting waiting. This section of road, currently entered under “Commercial Buildings” should therefore be re-entered under Le Quai aux Marchands.
Discussion
The temporary amendments made in 2011 are summarised below.
Oxford Road (Parish administered road): -
- Traffic flow Changes:- One Way in a northerly direction between L’Avenue et Dolmen du Pres des Lumieres and Stopford Road, except for cyclists.
- Parking Changes – removal of the most southerly parking space in Oxford Road (2 hour Paycard parking will be extinguished to enable greater separation between cyclists and motorists at the junction with L’Avenue et Dolmen du Pres des Lumieres). This will however still leave two spaces that are not reserved exclusively for residents.
Gas Place:
Parking Changes (Parish administered road): -
- The removal of six parking spaces and complete removal of all associations with Schedule 8 Part 3 - Paying Parking Places – 2Hour Limit.
Commercial Buildings: -
Parking changes as a result of the recent highway upgrading scheme and the introduction of a cycle path.
- Paying Parking Places 1 Hour limit – West Side from No 25 for a distance of 114 yards in a southerly direction, and a point 151 yards south of a point 3 yards south of the northern boundary of No.25 and a point 35 yards further south
- Parking Discs 6 Hour Limit:- West side 186 yards south of a point 3 yards south of the northern boundary of No 25 and a point 19 yards further south
- Parking Discs 6 Hour Limit: - Between English Harbour Slip and the corner immediately west of the harbour
- Parking for motorcycles and Mopeds – West Side (between a point 145 yards south of a point 3 yards south of the northern boundary of No 25 and a point 6 yards further south.
- South side – from a point 9 yards west of the western edge of the northern slipway of English Harbour to a point 8 yards further west.
The temporary amendments made in 2012 summarised below
Esplanade:-
Changes to unloading bay times.
The unloading bay outside No 5 and 6 Esplanade – North side between a point 188 yards east of its junction with Castle Street and to a point 12 yards further east - Unloading 2am – 3pm Maximum 20 minute stay. Between 3pm and 2am unloading and parking will not be permitted. The purpose of the restriction is to allow Al Fresco furniture to be set up in the bay after 3pm.
Other required amendments
Le Quai aux Marchands
The current prohibition of waiting along this length of road is entered in the order as part of Commercial Buildings. The order should now describe these lengths as:-
“East side (between Mount Bingham and the western edge of the northern slipway to the English Harbour)”
“West Side (between the eastern side of the northern slipway to the English Harbour and the entrance to South Pier”)
Recommendation
The Minister is requested to approve the request.
Reason (s) for Decision
To amend the Road Traffic (St Helier) (Jersey) Order 1996 to make permanent the temporary amendments made under Article 68 of the Road Traffic Law and to make corrections to some articles where errors have been noticed
Action Required
Officers are to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.
