Rent Control Tribunal - nomination of Chairman and Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

PROPOSITION

 

THE STATES are asked to decide whether they are of opinion:-

 

                   In pursuance of paragraph (1) of Article 3 of the Dwelling Houses (Rent Control) (Jersey) Law 1946, as amended, to appoint the following persons to act as Chairman and Members of the Rent Control Tribunal for a period ending on 12th April 2009, namely –

 

                            Mr Eric Henry Le Ruez - Chairman

                            Mr David Leon Crespel

                            Mr Jeremy James Robin Johnson

                            Mrs Mary Margaret Gaiger

REPORT

 

Article 3 of the Dwelling Houses (Rent Control) (Jersey) Law 1946, as amended, provides for the States to appoint a Rent Control Tribunal consisting of a Chairman and not less than three, nor more than four other Members. The Law also provides that the Chairman and two other Members constitute a quorum for any sitting of the Tribunal.

 

Regulation 2 of the Dwelling Houses (Rent Control) (Jersey) Regulations 1946 states that the Chairman and Members of the Tribunal shall hold office for a period of twelve months ending on the 12th April each year, and be eligible for re-appointment.

 

In July 2006 the States approved two new Members, Mr Jeremy Johnson and Mr David Crespel to join existing Tribunal Members, Mr Ronald Welling and Mrs Mary Gaiger. The appointment of the two new Members at that time followed a public advertisement and interview process. All four Members agreed to allow their names to be put forward for nomination for a further term which ended 12th April 2008.

 

Unfortunately, the Chairman, Mr Ron Welling, who has served on the Tribunal for a number of years, has now decided to stand down from his position to concentrate on enjoying his retirement and several other business interests. The remaining three Members, however, have agreed to allow their names to be put forward for nomination for a further twelve month term.

 

Mr Eric Le Ruez, former Chief Executive Officer of the Housing Department and Director of the Property Holdings Department before his retirement in September 2007 has been approached and kindly agreed to allow his name to be put forward for nomination as Chairman of the Tribunal. Mr Le Ruez has vast experience in property matters, knowledge of legal procedures and the background to be able to determine in a just manner the issues coming before the Tribunal.

 

The Minister accordingly has the pleasure in nominating the persons named below for a period ending 12th April 2009.
