Amendments to Road Traffic (Public Parking Places) (Jersey) Order 2006.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Road Traffic (Public Parking Places) (Amendment No 2) (Jersey) Order 2009

Decision(s): The Minister made the Road Traffic (Public Parking Places) (Amendment No 2) (Jersey) Order 2009, to become effective seven days after it is made, the purpose of which is to: 

  1. Add La Rosiere Car Park to the Order and place a restriction on waiting of a maximum of 12 hours in any continuous 24 hour period;
  1. To place a restriction on waiting at St Peter’s Parish Hall Car Park of a maximum of three hours in any stay

Reason(s) for Decision: To amend the Road Traffic (Public Parking Places) (Jersey) Order 2006.

Resource Implications: Production and installation of new signage by Transport and Technical Services Department £200, advert in JEP Gazette £100 – total £300. Production and installation of new signage by the Parish of St Peter £300.

Action Required: To notify the Greffier of the States and the Law Draftsman that the Order has been made and forward the signed and sealed Order to the Publications Editor, States Greffe, for notification to the States.

TRANSPORT AND TECHNICAL SERVICES  

ROAD TRAFFIC (PUBLIC PARKING PLACES) (JERSEY) ORDER 2006 – AMENDMENTS  
 

Purpose of the Report  

To add a new car park and to introduce a maximum 3 hour stay at St Peter’s Parish Hall Car Park to the Order. 
 

Discussion  

On 8 May 2009 the Minister approved a request from the Connétable of St Peter to introduce a maximum 3 hour stay at St Peter’s Parish Hall Car Park to the Road Traffic (Public Parking Places) (Jersey) Order 2006 under MD-T-2009-0047. 

On 14 May 2009 the Minister approved the introduction of La Rosiere Car Park at Corbiere to the Road Traffic (Public Parking Places) (Jersey) Order 2006 under MD-T-2009-0050. 

The Transport and Technical Services Department has responsibility for administration of this area and in order to enable Parking Control to administer the car park it has been scheduled in the Road Traffic (Public Parking Places) (Jersey) Order 2006.  

A maximum stay period of 12 hours in any continuous period of 24 hours has also been applied for La Rosiere Car Park. 
 

Recommendations  

The Minister is requested to approve the Amendments to be effective from seven days after the Order is made.

  1. To allow the addition of La Rosiere Car Park to the Order with a maximum of 12 hours in any continuous 24 hour period

 

  1. To place a restriction on waiting of three hours in any visit to St Peter’s Parish Hall Car Park
