Delegated Authority Decisions - Property Holdings

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister noted the decisions taken by officers under delegated powers in the period 5/01/07 to 11/01/07.

Land Adjacent to Le Pres D’Auvergne Car Park, L’Etacq, St Ouen - Lease renewal for one year to Mr Colin Graeme Luce. The existing annual rental is £600 and the new rental is £1,000 per annum.

No 1 Howard Davis Farm, La Route de la Trinité, Trinity - Lease renewal for one year to Mr Scott Meadows. The existing rental is £12,000 and the new rental is £12,432 per annum.

186 Clos des Sables, St Belade - To rescind the previous decision dated 5 December 2006 to a contract of sale of the unexpired portion of the present 99 year leaseby Miss Heidi Frances Norman to Mr Andrew Charles Cummings as the transaction was not completed. For the Public to be party to a contract of sale of the unexpired portion of the present lease (58 years and 6 months) to Mr David Carey and Mrs Linda Carey née Raynes.

Reason(s) for decision:

To note the officer decisions in respect of the above lease renewals and contract of sale of the unexpired portion of a lease made under delegated powers in accordance with the Minister’s Decision of the 20 February 2006.

Action required:

The Director of Property Holdings will advise the relevant departments of the Minister’s decisions.
