Jersey Car Rally 2014: Law drafting instructions for preparation of an Order

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the preparation of an Order under Article 2 of the Motor Vehicle Races (Jersey) Law 1946 to enable the Jersey Car Rally 2014.

 

Reason(s) for Decision: The Minister accepted that the proposed road closures and associated traffic management appeared both reasonable and justified.

THE JERSEY MOTOR CYCLE AND LIGHT CAR CLUB’S APPLICATION TO

 

HOLD THE ‘JERSEY CAR RALLY’ 2014

 

 

 

Purpose of the Report 

 

To obtain a Ministerial Decision regarding approval of road closures and traffic restrictions for the purpose of holding the Jersey Rally on Friday 10 October and Saturday 11 October 2014.

 

In addition, to enable an instruction to be sent to the Law Draftsman requesting preparation of an Order under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.

 

 

Background

 

The Jersey Motor Cycle and Light Car Club (the Promoter) has submitted details of its proposed ‘Paperclix Rally’ for 2014. The event is enabled by Order of the Transport and Technical Services Minister under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.

 

The Promoter has consulted with the Connétables of all Parishes within which stages of the Rally are to be held and has provided TTS with signed certificates of support in each case. They have also consulted property owners directly affected by road closures and supplied proof of Public Liability Insurance.

 

 

Discussion

 

Of the various main road sections included in this year’s Rally (see attached Rally Stage Plans and Schedule) all the stages have been utilised in the last two to five years, although there are some minor alterations. Most significant, with respect to traffic impact, will be the following closures:

 

St Brelade Stage: Friday 10 October 12pm – 5pm:  La Rue de Mans, le Mont aux Roux

 

Hetres Stage: - Friday 10 October 6pm – 10pm: La Rue de la Vallee (B26), les Mont des Routers (B68), La Rue des Hetres (B69)

 

North Stage: Saturday 11 October 7.45am – 12.45pm: La Route du Nord, Le Route de Mont Mado

 

Trinity Stage: - Saturday 11 October 12.45pm – 17.30pm: Le Rue de la Chesnai (B51)

 

Waterworks Valley Stage: Saturday 11 October 7.45am – 12.45pm: Le Chemin des Moulins (C118), La Route de St Jean, Le Route du  Mont Cochon (B27) from La Rue des Moraines to Fern Valley

 

The relevant Parishes are fully aware of the traffic implementations of these stages on Parishioners etc. but have confirmed their approval. Otherwise all stages have been designed to minimise their traffic impact.

 

 

Public Bus Service Impact

 

For information regarding the impact on public bus services please see the attached ‘Scheduled Changes to Public Bus Services’.  Bus routes affected are the 4, 8, 28 and 9.

 

 

Recommendation

 

The Minister is recommended to approve the Jersey Rally and the preparation of an Order under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.
