Policing of Parks (Jersey) Regulations 2005: 'Authorised Persons': Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

POLICING OF PARKS (JERSEY) REGULATIONS 2005 – APPOINTMENT OF

 

AUTHORIZED PERSONS

 

 

Purpose of the Report

 

For the Minister to agree to a proposal to appoint “authorized persons” under the Policing of Parks (Jersey) Regulations 2005.

 

 

Background

 

Offences under the Policing of Parks (Jersey) Regulations 2005 are often, in the first instance, dealt with by frontline staff from the various departments who administer land listed in the Schedule of the Regulations.  To comply with the Regulations and empower these staff, they must be formally appointed as authorized persons and issued with identity cards.  These authorized persons are appointed by the “park authority” which in this case is the Minister for Transport and Technical Services.

 

 

Discussion

 

Frontline staff are having to deal with reports of unacceptable behaviour that unreasonably interferes with the comfort or convenience of other users of parks and that causes them annoyance or interference with their enjoyment of the park.  This includes dog fouling, litter left in parks and anti-social behaviour, and in order to ensure the Regulations are upheld, Officers have requested that Parks and Gardens staff, along with the Parish of St Helier Town Wardens and Countryside staff from the Environment Department are appointed as authorized persons who can report offenders.

 

If the person fails or refuses to comply with this requirement, or gives a false name or address, they shall be guilty of an offence and liable to a fine of level 2 on the standard scale.

 

The ability to report offenders and take them successfully to prosecution would go some way to ensuring that the facilities provided by Transport and Technical Services Department are not abused and can be enjoyed by the majority of people visiting the Park rather than spoilt by a minority.  It is for this reason that it is felt that the staff, Wardens and Countryside staff should become authorized persons.

 

 

Recommendation

 

The Minister is recommended to approve the appointment of staff listed on the attached sheet as authorized persons under the Policing of Parks (Jersey) Regulations 2005.
