A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment;

Confirmed the registration of 13 Charles Street St Helier as a BLI but noted that this is a very marginal case and should not be regarded as a preclusion to the consideration of a replacement building providing that exceptional architecture is delivered and the nature of the neighbouring building respected.

The Registration of 13 Charles Street, St Helier as a BLI is in accordance with the selection criteria which states that any building which survives in recognisable form from before the middle of 19th Century will normally be of registerable quality for its historic interest

Relevant interests of the site (also see assessment form)  

13 Charles Street is currently unregistered although was identified as ‘Building Frontage of Townscape Importance’ in the 1987 Island Plan. 

MRLAG first discussed the interests of 13 Charles Street at its meeting on 11 June 2007. At that meeting, members were unanimous that No.13 merits inclusion on the Register as a BLI for its architectural, historical and scenic interest. A recommendation for the registration of 13 Charles Street as a BLI was subsequently put to the Minister at a meeting on 26 June 2007 and again on 18 January 2008, but on both occasions a decision was deferred. The Minister undertook a site visit on 29 February 2008 after which he requested that MRLAG undertake a further site visit and reconsider the registration issues.     

13 Charles Street has historic interest as a circa 1830 building that was part of the unprecedented expansion of the town from its small historic core in the early 19th century - as recorded on the Le Gros map of 1834. It occupies a prominent corner position and has group value with its neighbouring 19th century historic buildings - in particular No.15 that appears to be part of the same original development. The building makes a positive contribution to the character of the street and is part of the early 19th century historic grain of the town. 

The external envelope of the 1830s building remains largely intact and the building survives in recognisable form. There are later 19th century sashes and the apparent addition of moulded sill brackets and reticulated keystones to the windows - all of which can be now be considered to be part of the interest of the building. There are later 19th century dormers and the chimneystack has been overclad with fibreglass and the pots removed - but otherwise appears to remain intact. There is a mid-C20 shopfront.  

Advice received (MRLAG or others)  

MRLAG visited 13 Charles Street at its meeting on 17 March 2008. Members were unanimous that the building merits inclusion on the Register as a BLI as it has historic and architectural interest as an early 1830s building that was part of the early 19th century expansion of the town; has group value with the neighbouring 19th century historic buildings, particularly No.15, and makes a positive contribution to the character of the street.

13 Charles Street should be added to the historic buildings register as a BLI. 

Justification relating to criteria  

The registration of 13 Charles Street as a BLI is in accord with the selection criteria, which states that buildings included in the Register are those which retain their historic form and detail, and so make a significant and positive contribution to the architectural and historical character and appearance of Jersey. The registration is also supported by the criteria which states that any building which survives in recognisable form from before the middle of the 19th century will normally be of registerable quality for its historic interest.
