Road Traffic (St. Saviour) (Amendment No. 8) (Jersey) Order 2014

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision: At the request of the Connetable of St Saviour to introduce prohibition of waiting areas in the Parish.

ROAD TRAFFIC (ST SAVIOUR) (JERSEY) ORDER 2000

 

 

Purpose of the Report

 

To amend the Road Traffic (St Saviour) (Jersey) Order 2000 to introduce new prohibition of waiting restrictions and create a new article permitting the use of parking discs in the Parish.

 

 

Background

 

Amendment to Schedule 3 “Prohibition of Waiting” of the Road Traffic (St Saviour) (Jersey) Order 2000

 

The Connétable of St Saviour has requested to prohibit waiting on Fountain Lane in locations commonly used as passing places for vehicles. These locations are now being utilised as parking places, making it difficult for vehicles to pass one another when travelling in opposite directions.

 

Amendment to Part 3 of the Road Traffic (St Saviour) (Jersey) Order 2000 “Limit on Parking” creating article 7A of the order and schedule 6 for Disc Parking

 

The Connétable has requested to limit the length of time vehicles can remain parked on La Rue de la Croix Besnard. It is felt that this road is being used for all day parking by people walking to town and students who drive to school. As such the Parish would like to introduce a 2 hour disc zone along the length of the road to deter such activity.

  • East side (from a point 132 yards north of its junction with Belvedere Hill for a distance of 15 yards in a northerly direction)
  • East side (from a point 199 yards north of its junction with Belvedere Hill for a distance of 7 yards in a northerly direction)
  • East side (from a point 270 yards north of its junction with Belvedere Hill for a distance of 17 yards in a northerly direction)
  • East side (from a point 334 yards north of its junction with Belvedere Hill for a distance of 4 yards in a northerly direction)
  • West side (from a point 199 yards north of its junction with Belvedere Hill for a distance of 9 yards in a northerly direction)”.

  • From a point 31 yards east of the junction with Les Varines to a point 56 yards further east (both sides)
  • From a point 100 yards east of the junction with Les Varines to a point 56 yards west of Rue de Beauvoir (both sides)

 

 

Recommendation

 

Further to MD-T-2014-0030, The Minister is recommended to approve the Road Traffic (St Saviour) (Amendment No 8) (Jersey) Order 2000, attached, to come into force seven days after it is made.

To amend the Road Traffic (St Saviour) (Jersey) Order 2000 introducing article 7A to Part 3 “Limit on Parking” and Schedule 6 to the order, and to amend Schedule 3 “Prohibition of Waiting”.
