A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

INCREASE IN FEES 2007

Purpose of the Report

To consider the Motor Vehicles (Construction and Use)(Amendment No. 8)(Jersey) Order 2007, which will increase fees.

Background

On the basis of Ministerial Decision MD-T-2006-0095, it was decided to increase fees for services provided by Driver and Vehicle Standards by approximately 2.5 percent, in line with States policy.

Discussion

The Law Draftsman was asked to prepare the necessary changes to the Order on the basis of a brief provided by the Department.

The Motor Vehicles (Construction and Use)(Amendment No. 8)(Jersey) Order 2007 is attached for the Minister to make the Order. Making the Order will implement the increase in charges and will come in to force on 1st February, 2007.

Recommendation

The Minister is recommended to make the Motor Vehicles (Construction and Use)(Amendment No. 8)(Jersey) Order 2007 and request the Department to take the necessary action to implement the Order.

THE MINISTER FOR TRANSPORT AND TECHNICAL SERVICES, in pursuance of Articles 38(2)(a) and 46 of the Motor Traffic (Jersey) Law 1935, orders as follows –

1 Schedule amended

For the Table in the Schedule to the Motor Traffic (Cabs - Fares and Charges) (Jersey) Order 2006 there shall be substituted the following Table –

		“TABLE OF FARES AND CHARGES
		Journey charges
		1.			Hire starting after 7 a.m. but before 11 p.m. on any day (subject to 3 and 4 below)
		Distance fare –
		For the first 218 yards or any shorter journey –						£2.30
		For each additional 367 yards or part of any additional such distance –						30p
		Waiting charge –
		For each 68 seconds, whether consecutive or not, during which the taxi-cab is stationary –						30p.
		2.			Hire starting after 11 p.m. but before 7 a.m. on any day (subject to 3 and 4 below)
		Distance fare –
		For the first 275 yards or any shorter journey –						£2.50
		For each additional 234 yards or part of any additional such distance –						30p
		Waiting charge –
		For each 60 seconds, whether consecutive or not, during which the taxi-cab is stationary –						30p.
	3.			Hire starting – · after 7 a.m. but before 11 p.m. on a Sunday · after 7 a.m. but before 11 p.m. on a public holiday or a bank holiday · after 8 p.m. but before 11 p.m. on Christmas Eve or New Year’s Eve
	Distance fare –
	For the first 301 yards or any shorter journey –						£2.30
	For each additional 274 yards or part of any additional such distance –						30p
	Waiting charge –
	For each 60 seconds, whether consecutive or not, during which the taxi-cab is stationary –						30p.
	4.			Hire starting – · after 11 p.m. on Christmas Eve and before midnight on Boxing Day · after 11 p.m. on New Year’s Eve and before midnight on New Year’s Day
	Distance fare –
	For the first 218 yards or any shorter journey –						£4.40
	For each additional 195 yards or part of any additional such distance –						30p
	Waiting charge –
	For each 34 seconds, whether consecutive or not, during which the taxi-cab is stationary –						30p.
Additional charges
1.			If hire starts at a seaport or the Airport –			40p
2.			For each article or package carried other than in the passenger compartment of the cab –			10p
3.			For each additional passenger carried (except a child under 3 years old) – (Two children aged 3 years or more but less than 12 years being counted as one passenger)			10p”.

This Order may be cited as the Motor Traffic (Cabs - Fares and Charges) (Amendment) (Jersey) Order 200- and shall come into force on 24th July 2006.
