Capital Business Unit Closures - Budget Transfers.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

To agree the transfer of net unspent budgets to the Treasury and Resources Department and to transfer the budgets of various completed capital projects to completed works.

Decision(s):

      The Minister approved that;-

  1. the net unspent budget on the Capital Projects detailed in the annexed report be transferred to the Treasury and Resources Department.
  2. the budget recorded against the capital projects listed in the schedule contained in the annexed report should be transferred to completed works on the Department’s Balance Sheet

Reason(s) for Decision:

In order that the Department’s accounting records could be updated to properly reflect the status of the projects and to ensure the proper treatment of capital funds in accordance with Financial Direction 5.6.

Senior Management Accountant to update the accounting systems and notify the Treasury and Resources Department of the decision and to request that the Treasury & Resources Minster approve the transfer in accordance with Financial direction 3.6.

REPORT FOR HOUSING MINISTER

SUMMARY REPORT ON THE CLOSURE OF CAPITAL BUSINESS UNITS  

The Housing Department has a number of capital projects which have now been completed.  The budgets for those projects now need to be transferred to “Completed Works” on the States of Jersey Accounting Systems and in the course of that process will be transferred between capital heads of expenditure.  Financial Direction 3.6 issued under the auspices of the Public Finances (Jersey) Law 2005 directs that such transfers require the approval of the Treasury and Resources Minster. 

In addition to the transfer to completed works there are a number of under spends on centrally funded capital budgets which are required to be returned to the Treasury and Resources Department.  T&R have agreed that, before such a transfer is made, the Housing Department will be permitted to allocate those savings to net off other completed projects.  Once this allocation has taken place the overall transfer to be made back to the Treasury and Resources Department is £117,778.24.
