Amendments to the Water (Jersey) Law 1972.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report  

To provide the Minister with the rationale for requesting an amendment to the Water (Jersey) Law 1972 in respect of Jersey water’s ability to carry out the replacement and renewal of its pipes and apparatus on private land.   

Background  

Jersey Water have been in discussion with the Director of Environment in respect of the difficulties that have experience in being required to serve notice on all the owners of private land when carrying out the replacement or renewal of pipe work. It was concluded after discussion with the Law Officers Department that to overcome these difficulties the law would need a minor amendment. The Chairman of Jersey Water wrote to the Minister on the 21 November to seek such a change to the law 

Discussion  

Whilst the Law under Article 3.8 provides for Jersey Water have “access thereto by its servants or agents at all reasonable times for the purpose of inspection, maintenance and repair” it is not clear if this can be construed to include the replacement and renewal of pipes and equipment.  As many modern repairs are achieved by laying new pipes adjacent to existing ones and by upgrading equipment with modern equivalents e.g. a meter chamber rather than a valve box they are not specifically “like for like” and may be judged to be going beyond the meaning of “repair”. Having to notify all the owners and occupiers in a private road when, for instance, installing a meter chamber at the request of one property owner is a time consuming and unnecessary process.  It is not consistent with the States policy of reducing red tape. The situation could be resolved very easily by a minor amendment to the law that adds the terms “replace or renew” to the permitted actions mentioned in article 3.8 

Recommendation  

To support Jersey Water’s request and to seek a minor amendment of the Law.
