Odeon Cinema, Bath Street, St. Helier - Listed Building

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

  1. On the basis of the basis of the relevant evidence provided to him, and taking into account only those material considerations that relate to the special architectural and historic interest of the Odeon Cinema, as required to do so and prescribed by law, the Minister for Planning and Environment resolved that the building and place should be retained as a Listed Building (on the List of Sites of Special Interest);
  2. The Minister further determined that, in light of the introduction of the new historic environment protection regime at the beginning of 2011, work should be undertaken by Jersey Heritage, as soon as possible, to assign a (non-statutory) grade to the Listing of the building in order to inform any future decision on the potential redevelopment of the building and to inform an assessment of its potential for change.

Reason(s) for Decision:

  1. The special architectural and historic interest of the Odeon Cinema, Bath Street, St Helier, as defined in the schedule and relative to the published criteria for selection, justifies its inclusion on the List in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 and;
  2. It accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets;

Legal and Resource Implications:

  1. Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to include on a List those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attached to the building or place.
  2. Article 51(5) of the Planning and Building (Jersey) Law 2002 enables the Minister to remove a building or place from the List where he is satisfied that its special interest has ceased to exist.
  3. Article 52(4) of the Planning and Building (Jersey) Law 2002 states that in determining whether to include a building or place on the List, the Minister shall take into account representations to the extent that they relate to the special interest of the proposed site.

  2.      Update the List
  3.      Notify Development Control
