The Minister for Infrastructure has approved a policy for dealing with encroachments on the foreshore.
The Jersey Property Holdings section of the Department for Infrastructure (DfI) has been dealing with encroachments on the foreshore since the early 1990s with evidence of cases going back considerably earlier than that.
The policy has been developed to help the public understand the actions the department intends to take when coastal properties have encroached onto public land either recently or historically.
DfI will be adopting a pro-active approach to dealing with and resolving encroachments on the foreshore. It will take a measured approach depending on the degree of encroachment, although there is a general presumption that the public should, wherever possible and practicable, have access to the foreshore it owns. There is also a presumption that if the public agrees to allow an encroachment, the private individuals who benefit should compensate the public for their personal gain.
