If you are on Probation you must follow strict conditions, such as attending regular meetings with your Probation Officer. If you break any rules, you may receive a warning or be ordered to return to court.
A Probation Order can be breached in various ways, such as:
- leaving the Island without written permission from the Probation Service
- disruptive behaviour on programmes
- not engaging in the supervision process
- not letting us know if you have moved home or employment
- if you re-offend
- not keeping your appointments without notifying your Probation Officer
If you break the rules of your Probation you will either:
- receive a warning or
- be taken back to court
If the court finds you have breached the Probation Order, it may do one of the following:
- allow the Probation Order to continue
- change some of the terms and conditions
- sentence you for the original offence, eg by giving you a fine or prison sentence
If you have to go back to court, you should see a lawyer. The Probation Service will tell you how to do this.
If you are in breach of your order and leave Jersey, the States of Jersey Police may come and arrest you and bring you back to the Island. If this happens, you may be kept in prison until your court date.
