About the consultation
The use of machinery at work can give rise to numerous health and safety risks which should be considered at all stages in a machine's life, from its manufacture, commissioning, installation and use in the workplace, through to its disposal and dismantling.
The proposed approved code of practice (ACoP) on safety in the use of machinery will apply to all machinery used in the workplace, with the exception of woodworking machinery which is covered by ACoP 9 (the safe use of woodworking machinery).
The proposed code will not introduce new legal requirements but it is intended to provide practical guidance to designers, manufacturers, suppliers, employers and employees so they can meet the legal duties placed on them under Part 2 of the Health and Safety at Work (Jersey) Law 1989.
It is also recognised that the legal requirements for the safety of machinery set out under the Safeguarding of Workers (Machinery and Woodworking Machines) (Jersey) Regulations, 1967, are outdated and do not reflect current standards. It is intended that the introduction of this new ACoP, together with ACoP 9, will result in the revocation of these regulations.
Senator Francis Le Gresley, Minister for Social Security, intends to give approval to a new Code of Practice on Safety in the Use of Machinery under Article 10 of the Health and Safety at Work (Jersey) Law, 1989.
Senator Le Gresley is inviting comments, including on the manner in which the publication is structured and the advice that is provided, for consideration before he gives formal approval.
