Produced by the Freedom of Information office
Authored by Government of Jersey on behalf of the States Greffe and published on 31 January 2018.
Prepared internally, no external costs.

Request

Can you please provide a list of States Members that voted on any day last year (2017) but failed to vote on a particular proposition that same day, and please state the particular proposition that they did not vote on.

Response

The information requested is absolutely exempt under Article 23 of the Freedom of Information (Jersey) Law 2011 (Information accessible to applicant by other means).

The information required in order to answer the above question is already available on the States Assembly website and the explanation below fulfils the obligation under Article 23(2) by informing you where and how this information can be obtained.

Details of how each States member voted on a particular day are available at the following link:

States Members

In order to locate the information requested, click on the member you require and scroll down to their voting record details. Click again on the year you require and all propositions for that particular year will be listed, including the day on which they were debated, and whether the States member voted Pour, Contre, Abstained or was not present for the vote. From the list, it will therefore be apparent if a member voted for some propositions on a particular day and was not present for others.

Alternatively all the voting records for the States Assembly in 2017 are available on the States of Jersey Open Data site at the following link:

States Assembly Voting Records

The information is available in CSV, XML and JSON formats and can therefore be manipulated electronically.

Article applied:

Article 23 Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.

This response has been issued on behalf of the States Greffe. The States Greffe is responsible for the information held by (and on behalf of) both itself and the States Assembly.  Neither the States Assembly nor the States Greffe form part of the Government of Jersey and the Government was not involved either in the examination and retrieval of any information required for this response, nor in the drafting of the response itself.
