Financial implications of Ministerial Decisions (FOI)

Could you please release the information in regard to the financial implications in collecting monies on the following Ministerial decisions (DfI) and the monies received in pursuance of these decisions.

To include, legal costs, surveyor / valuation costs and manpower resources in collection of monies.

Please itemise per decision and indicate costs involved whether recovered by the department from the homeowner or sustained by the department.

The ministerial decisions applicable are.

Decision Reference: MD-PH-2018-0005 Ref St Martin seawall granting of rights

Decision Reference: MD-PH-2013-0012 Ref Green Island granting of rights

Decision Reference: MD-PH-2013-0048 Ref Green Island granting of rights

Response

To clarify, the question relates to four properties, as the Ministerial Decisions “MD-PH-2013-0012” and “MD-PH-2013-0048” both relate to the same 2013 contract at “Beach House”, Green Island.

Of the four properties only two have passed before the Royal Court:

• "Beach House”, Green Island (to which the Public were party) on the 11 October 2013; and

• “Zanzibar”, St Brelade on the 29 September 2017

“La Cotte”, Ouaisne and “Beach Hotel”, St Martin are yet to pass through the Royal Court.

On the “Beach House”, Green Island contract, where the Public was party to the sale, cession and transfer of rights by The Crown, there was the payment by the purchasers of a total of £5,500 for professional fees and disbursements incurred by the Vendor and the Public in respect of the passing of the contract.

On the “Zanzibar”, St Brelade contract, where the Public granted drainage rights beneath the promenade onto the Foreshore, there was the payment by the acquiring party of a total of £3,500 for professional fees and disbursements incurred by the Public in respect of the passing of the contract.

Copies of these two property contracts, that show the payments as part of the consideration paid, can be found in the Public Registry.

The other two contracts will be available on the Public Registry as and when they are passed through the Royal Court.

With regard to manpower costs incurred by the department, this information is not recorded, as such costs are contained within the costs of running the department as a whole.
