Given that 11 March 2018 will mark the two year anniversary of the approval of the allocation of the La Collette Terminal lease to La Collette Terminal Limited (LCTL), a subsidiary of Rubis, we are seeking clarification on the following matters:
A
The minutes from the Public Accounts Committee (PAC) review of the La Collette Terminal lease state that "CICRA have already included in their work programme for 2016 a review of the effectiveness of the conditions that they imposed at the fuel farm".
How many of these reviews have taken place since the lease was signed?

If any reviews have taken place, did LCTL (Rubis) meet the conditions laid out by the Channel Islands Competition and Regulatory Authorities (CICRA); including safety work being done to a 'tight timescale'?

The minutes from the PAC review of the La Collette Terminal lease also state that "it is still necessary to conduct a fuller review of LCTL's compliance with the Conditions (of the lease) in order to ensure that there is no other evidence of conduct that may give rise to vertical concerns in the future."
Has this fuller review taken place, and what were the findings?

The Channel Islands Competition and Regulatory Authorities (CICRA) is an independent body and therefore does not currently fall within the definition of a Scheduled Public Authority under Schedule 1 of the Freedom of Information (Jersey) Law 2011. Subsequent to the Jersey General Election in May 2018, the newly constituted Public Accounts Committee may decide to further review this subject.
This response has been issued on behalf of the States Greffe. The States Greffe is responsible for the information held by (and on behalf of) both itself and the States Assembly. Neither the States Assembly nor the States Greffe form part of the Government of Jersey and the Government was not involved either in the examination and retrieval of any information required for this response, nor in the drafting of the response itself.
