Day nurseries and pre-schools registered under the Day Care of Children (Jersey) Law are privately run businesses. It has been established that a breakdown of this information would likely prejudice the commercial interests of the providers and is therefore exempt under Article 33 of the Freedom of Information (Jersey) Law 2011. Day nurseries cater for children from birth to school age and therefore caution should be used when comparing this to States of Jersey Nursery classes (or Nursery classes in some private schools) which only cater for three and four year olds.

The Department records all complaints received. The figure above represents complaints and concerns received by telephone or in writing in the last six years. This includes concerns received about business or contractual issues which are not under the remit of the Department’s role as the regulator.

Places that provide free early learning

Due to the small number of complaints received we are unable to provide a breakdown by school as revealing this would likely breach the privacy of the individuals and therefore Article 25 of the Freedom of Information (Jersey) Law 2011 has been applied to this request.

Article 25 Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if -

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.

Information is qualified exempt information if –

(a) it constitutes a trade secret; or

(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).
