In 2012 a sensational outside Journalist with a recorded disdain of Jersey's Finance Industry claimed to have been stopped from entering Jersey as they were trying to investigate allegations of a cover-up regarding the Jersey child abuse investigation. This ban was eventually lifted a year later and a Visa allowing the journalist to visit was issued. We can only assume that no cover-ups were actually found as the journalist went quiet.

However I would like to know the true events as to why the journalist was refused entry into Jersey in 2012, and what protocols are in place for the Jersey Customs and Immigration Service when dealing with access requests in similar circumstances?

Response

The information regarding the first part of your request is personal data regarding an individual’s immigration status and activity and is therefore exempt from disclosure under Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011.

In response to the second part of your request, the Jersey Customs and Immigration Service follow States of Jersey guidelines on ‘Handling Subject Access Requests’. See the attachment below:

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
