During the period in question, subsequent to road traffic collisions, five persons aged 70 years or above were disqualified from driving by the court. Details of licence suspensions or revocations by a Parish Connetable (see H below) are not held by the States of Jersey Police. The applicant may wish to make a separate request to the Parishes.

Action against a driver is not age dependent. There are no special arrangements for drivers over 70 years old. Formal procedures will vary from case to case. The evidential and public interest tests will be applied as with any consideration for prosecution. Possible actions will include attendance at a Parish Hall Enquiry (which could result in a verbal or written caution, or a fine), or court appearance (which could result in a fine or disqualification from driving).

Action to ensure public safety may also be taken without the need to appear in court. Ability to drive is assessed by the level of danger he / she poses to the public caused by certain diseases or physical disabilities, not by age. A Connetable may require a person (of any age) to undergo a medical examination or to retake a driving test. The Connetable may suspend a person’s licence until such time as the result of the medical examination is known or the driving test is passed.

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.
