Please arrange to supply copies of all commercial Government of Jersey public liability insurance policy certificates with what is covered, policy numbers, providers and underwriters held by the Government of Jersey. In particular, please ensure that anything regarding ‘pollution liability’, ‘policy enhancement’ and ‘schedules of exclusions’ documents in relation to the commercial public liability insurance policy held by the Government of Jersey is included.

Furthermore please supply copies of the ‘certificate of indemnity’ from the Government of Jersey that may include the public insurance provider and underwriters, confirming that any injuries, damages or adverse health effects directly or indirectly arising out of, resulting from or contributed to by electromagnetic fields, electromagnetic radiation, electromagnetism, radio waves or noise, wireless RF radiation, microwave radiation, non-ionising radiation emitting devices and equipment.

Response

In respect of commercial Government of Jersey public liability insurance policy certificates, we can confirm that the Government of Jersey (GOJ) does not hold any such certificates. However, a ‘To Whom It May Concern’ letter is issued on an annual basis by the Government of Jersey’s insurance brokers, Marsh, which details the information required regarding the level of liability coverage, policy number, providers / underwriters of the cover. A copy of this letter is attached. Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011 has been applied to minor amounts of personal data.

The GOJ does not hold a certificate of indemnity concerning electromagnetic fields and other related matters. There is however reference to ‘Exposure to Electro-Magnetic Fields’ indemnity limit in the 2019 Liability insurance policy schedule, which confirms that such matters are included within the Government of Jersey’s public liability insurance arrangements. A copy of that policy schedule is attached. Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011 has been applied to minor amounts of personal data.

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.

(3) In determining for the purposes of this Article whether the lawfulness principle in Article 8(1)(a) of the Data Protection (Jersey) Law 2018 would be contravened by the disclosure of information, paragraph 5(1) of Schedule 2 to that Law (legitimate interests) is to be read as if sub-paragraph (b) (which disapplies the provision where the controller is a public authority) were omitted.
