Could you please provide me with the statistics related to prosecutions under The Proceeds of Crime (Jersey) Law 1999, specifically prosecutions under s.34A and s.34D? I simply wish to know how many prosecutions there have been, in Jersey, under these two sections of the Law. I require no information relating to specific cases, simply how many prosecutions there have been in total since 1999.

Response

For the purpose of this question “prosecution” is taken to mean the Institute or conduct of legal proceedings against a person or organisation.

There have been no prosecutions under Article 34A or 34D of the Proceeds of Crime (Jersey) Law 1999 over the period requested. Jersey’s Joint Financial Crimes Unit receives over 2000 Suspicious Activity Reports each year from regulated financial businesses. All information received through this gateway is assessed for its' viability regarding prosecution under relevant legislation. Where deficiencies are identified in a business reporting regime, scoping action is undertaken. Whilst no prosecutions have taken place under the Articles of legislation specified, alternate sanctions have been imposed by the Jersey Financial Services Commission.

Revisions to the Proceed of Crime (Jersey) Law 1999 came into force on 4 August 2014 and Article 34 has been changed and is now headed “Further disclosure permitted for certain purposes”.

It is important to note that whilst Articles 34A and 34D to which this question relates retain the same subtitles; the body of those articles is now reformed.
