Request

There have been 20 “Freedom of Information” requests made in the last month (between 2 July 2021 to 2 August 2021) for information relating to the effectiveness of the Covid-19 vaccine, namely the vaccination status of Covid-19 cases. Each of these requests has been rejected due to either or both Articles 16 and 36 of the Freedom of Information (Jersey) Law 2011.

Article 16 indicates the refusal to provide this information is due to the time needed to manipulate the data and the associated cost implications. Please advise how much time, at what cost and any other requisites would enable this information to be made available?

Article 36 indicates the refusal to provide this information is due to the fact that it may be published within 12 weeks of the initial Freedom of Information request. If this information is to be made publicly available, please confirm a timeframe?

A

It is considered that this question is not a Freedom of Information request as it is not specifically asking for information held. As advised in the previous responses, the Freedom of Information (Jersey) Law 2011 does not require a Scheduled Public Authority to manipulate data in order to provide a response. Article 3 has therefore been applied.

B

Every effort continues to be made to publish the data as soon as possible. A number of issues need to be resolved before this can happen and the current estimated timeframe is towards the end of September or early October.

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a) it is held by the authority, otherwise than on behalf of another person; or

(b) it is held by another person on behalf of the authority.
