Further to the Police (Complaints & Conduct) (Jersey) Law 202- Law please provide:

A

Details of the arrangements in place to be followed by the States of Jersey Police in the handling of formal complaints investigated including the decision regarding the assessment of severity of a police officers behaviour recommended by an off island police forces of police officers;

B

The details of the arrangements in place regarding Article 8 (1) (f) to (h); and

C

Regarding article 13 (1), those arrangements in place which do not generally accord with those implemented elsewhere in the British Isles.

Response

Although the Police (Complaints & Conduct) (Jersey) Law 202- has been approved by the States of Jersey, it is still to receive Royal assent. It is therefore not yet enacted and consequently there are no arrangements in place as yet to comply with this law. In addition, the regulations determining how the Law must be implemented have not yet been debated in the States of Jersey. Therefore, until the regulations are also passed the law cannot be used. The estimated time frame for review of the regulations is between 6-12 months.

Article applied

Article 3 - Meaning of "information held by a public authority"

For the purposes of this Law, information is held by a public authority if –

(a) it is held by the authority, otherwise than on behalf of another person; or

(b) it is held by another person on behalf of the authority.
