A.

Neither the land nor the right to build on it has been given to a private company.

B.

The private company has been given a period of exclusivity to develop a planning proposal for the site that provides for community services to be developed alongside commercial development, with the cost of the creating the community services being met as a ‘planning gain’ (‘cross-subsidy’) from the commercial development.

C.

In compliance with the exclusivity agreement the private company was required to provide a concept scheme that included demonstrating that sufficient planning gain to cross subsidise the construction of the community facilities that included the Sea Cadets HQ could be achieved in the order of £2 million. That concept scheme was approved by the Public and was developed into a full planning application lodged in the name of the company, supported by the Public and the Ports of Jersey.

D.

Payments made to the private sector company to date reimburse only pre-agreed third party costs incurred by them from suppliers, all made and approved on a case by case basis at cost.
The agreement between the private sector company and these suppliers is a commercial agreement between third parties.

E.

No other company can be considered to develop the site during the exclusivity period.

F.

No process of tender has been made for the development of the site.
