In response to a previous Freedom of Information request earlier this year, the Mental Health Care Group comprises the Associate Medical Director for Mental Health, the Associate Managing Director for Mental Health and the General Manager of Mental Health. Please provide the names of anyone who is at Directorship level.

A

Records show that Richard Downes was the first to occupy his post of Clinical Director within Mental Health, commencing 20 January 2017.

B

Employment records show that Richard Downes held the role of Clinical Director from 20 January 2017 through to 31 January 2019.

As part of the Government restructure under Charlie Parker, the post of Head of Mental Health was introduced to replace this role. The post of Head of Mental Health was held by Miguel Garcia-Alcaraz from 01 October 2019 through to 16 September 2021.

Subsequently, Adult Mental Health Services and Adult Social Care were integrated, and the role of Executive Director of Mental Health and Adult Social Care was introduced. This supersedes the previous posts. Andy Weir took up this role in January 2022 on secondment, and was appointed permanently from 01 February 2023 following the recruitment process detailed below in response to Questions 4 to 8.

A search of the Government of Jersey database shows no posts (current or obsolete) with the title of ‘Director of Mental Health’.

Mr Downes retired from Health and Community Services (HCS) in 2019.

Information in respect of the recruitment / appointment of the Clinical Director of Mental Health is beyond retention and is not available. Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

As noted in response to Question 2, the job titles / roles referenced have been superseded by the role of Executive Director of Mental Health and Adult Social Care.

This post was advertised internally and externally, and appeared in the live job advertisements on the gov.je website from 08 August 2022 to 22 August 2022.

The referenced roles of Associate Medical Director for Mental Health and Associate Managing Director for Mental Health appear in a Freedom of Information response in relation to the Mental Health Service structure in 2021. Neither role forms part of the current service or management structure. It is intended that an up-to-date management structure will be added to the Care Group pages on www.gov.je.

It should be noted that neither of these roles were at Tier 1 or 2. The previous post-holders would, therefore, be entitled to have their personal information protected in line with Freedom of Information and Data Protection legislation.

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a) it is held by the authority, otherwise than on behalf of another person; or

(b) it is held by another person on behalf of the authority.

Article 25 - Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.​
