Planning Application P/2022/0882 Refused by the Planning Committee 8 December 2022 for to alter/ create new vehicular access on to La Rue de la Clochette, St Martin which the applicant had already, without Planning consent, destroyed and removed illegally, an ancient roadside hedging and ancient mature trees. Upon the Planning Committee refusal the Committee ordered the applicant to reinstate the roadside hedging and reinstate the "unauthorised Field vehicular entrance." As of 8 July, no action has been taken against the Field Occupant to put the wrong right. 

Upon enquiring with Planning Enforcement I am advised that the occupant of these two fields is in contravention of the planning Law and remains so.

My question is what action is Planning Enforcement proposing to put this contravention right and when?

The Freedom of Information (Jersey) Law 2011 gives a right to request information that is held in recorded form, unless exempt.

This request poses a question rather than seeking information held in recorded form.  In any event, the information is not held, and Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.​
