For the five years from 2019 to 2023, please confirm the number of sexual assault and rape cases in Jersey broken down by year and by the nationality of the accused. 

A

The total number of reported sexual assault and rape cases.

B

The number of cases that proceeded to prosecution.

C

The number of convictions.

D

The average sentence length for convictions.

E

The number of cases which did not result in prosecution and reason for non-prosecution.

A

The States of Jersey Police can confirm that the total number of reported sexual assault and rape cases reported in the last five years can be found on Table 1 in Attachment 1. The types of reported cases are as follows:

  • Abuse of trust by a sexual act against a female child
  • Gross indecency with child
  • Indecent assault on a female
  • Indecent assault on male
  • Rape of a female
  • Rape of a female child aged 12 or younger
  • Rape of a male
  • Rape of a male child aged 12 or younger
  • Sexual penetration of a female child aged 12 or younger
  • Sexual Penetration of a female without consent
  • Sexual penetration of a male child aged 12 or younger
  • Sexual Penetration of a male without consent
  • Sexual touching of a female child aged 12 or younger
  • Sexual touching of a male child aged 12 or younger
  • Sexual touching of a male without consent
  • Sexual touching of female without consent
  • Unlawful sexual intercourse with an older female child
  • Unlawful sexual penetration of an older female child
  • Unlawful sexual penetration of an older male child
  • Unlawful sexual touching of an older female child
  • Unlawful sexual touching of an older male child
  • Unlawful Sexual Intercourse with a girl under 13 years
  • Unlawful Sexual Intercourse with a girl under 16 years.

Table 2 shows the number of cases that proceeded to prosecution, broken down by year. The nationalities of the accused are Eire, England, Germany, India, Jersey, Maderia, Mauritius, Mozambique, Northern Ireland, Poland, Portugal, Romania, Scotland, Tunisia, USA and Venezuela.

Please note that to provide a breakdown by nationality of the accused in addition to the year would mean we would be unable to ensure protection of the identity of individuals.  Article 25 (2) of the Freedom of Information (Jersey) Law 2011 has been applied.

Table 3 shows the number of convictions broken down by year.  The nationalities of those that have been convicted are Eire, England, India, Jersey, Madeira, Mauritius, Mozambique, Poland, Portugal, Romania, Scotland and Tunisia. Again, Article 25 (2) of the Freedom of Information (Jersey) Law has been applied.

A Scheduled Public Authority is not required to manipulate and create new data sets and to provide an answer to the request would require extraction and manipulation of data to produce new information; Article 3 of the Freedom of Information (Jersey) Law 2011 therefore applies.

Please see Table 4 in Attachment 2 for the number of cases that did not result in prosecution, broken down by reason for non-prosecution.  The nationalities of those accused are Australia, Brazil, Eire, England, France, Germany, Ghana, Guernsey, India, Iran, Italy, Jersey, Kenya, Latvia, Maderia, Malawi, Maldives, Nepal, Netherlands, New Zealand, Nigeria, Northern Ireland, Pakistan, Poland, Portugal, Qatar, Romania, Rwanda, Scotland, South Africa, Spain, Thailand, Tunisia, Venezuela, Wales, Zimbabwe and Unknown.

Articles applied

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.

Article 25 - Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.​
