Please provide all documentation and emails relating to Operation Coast from the police and Health and Safety Inspectorate (HSI).

If a reason is given by the police that the information cannot be made available to me at this time I would like it to be saved so that I can have access to it at a later date.

Response

Operation Coast is the investigation into the sudden death of an individual and the subsequent prosecution of two paramedics. The States of Jersey Police confirm that no information in respect of this investigation can currently be made available as to do so could be prejudicial to both the forthcoming court appeal, and a future inquest. Article 29(c) of the Freedom of Information (Jersey) Law 2011 has therefore been applied.

No information held by the police relating to this case will be destroyed until Article 29(c) no longer applies and ample opportunity has been permitted for this request, or a similar one, to be resubmitted. 

Under Article 20 of the Health & Safety (Jersey) Law 1989 it is a criminal offence for the Health and Safety Inspectorate (HSI) to disclose information obtained during the course of an investigation. Therefore, no recorded HSI information relating to Operation Coast can be disclosed. Article 29(a) has also been engaged.

Information is absolutely exempt information if the disclosure of the information by the scheduled public authority holding it –

(a) is prohibited by or under an enactment;

(b) is incompatible with a European Union or an international obligation that applies to Jersey; or

(c) would constitute or be punishable as a contempt of court.​​
