Please could you supply to me the tender rules for engagement of services through the Channel Islands Tenders portal.

My company is a registered user and I need to establish if submitting a tender means the information within that tender is confidential and therefore cannot be plagiarised.

If there is a breach and information in a tender response for a project is then shared with another company, who are then tasked with delivery of that project, to whom should such a breach be reported? Do you operate an arbitration type process?

A

The Channel Islands Procurement Portal is used by the States of Jersey to advertise tender opportunities, disseminate tender documentation, receive bids and exchange information in respect of specific tender opportunities. The Channel Islands Procurement Portal is a cloud based solution provided by Due North, a UK registered company. The solution is ISO27001 (2013) accredited.

Tendering processes and procedures are set out in Financial Direction 5.1, issued by the Treasurer of the States under the Public Finance (Jersey) Law 2005. All financial directions are currently being reviewed and are expected to be re-issued later in 2016.

Information submitted via the Channel Islands Procurement Portal cannot be viewed by any supplier or third party and is secure in accordance with ISO27001. Tender submissions cannot be viewed by anyone in the States of Jersey until the date and time for tender release is passed. There is a process of verification which is managed and controlled by the Corporate Procurement team.

All tender submissions are treated as commercially sensitive and confidential documents.  Internal access to the tendering system is controlled and limited to named individuals, on a project by project basis.

Serious concerns such as described should be directed to the Director of Strategic Procurement in the first instance. In the event of any concerns not being satisfactorily addressed, there is scope for the matter to be referred to the Treasurer of the States (as Accounting Officer).

Under Article 2 of the Administrative Decisions (Review) (Jersey) Law 1982, any person aggrieved by any decision made, or any act done or omitted, relating to any matter of administration may apply to the Greffier of the States for the matter to be reviewed by a Complaints Board.
