Road Traffic (St. Brelade) (Jersey) Order 1990 - Amendment.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Road Traffic (St Brelade) (Jersey) Order 1990 - Amendment

Decision(s): The Minister made the Road Traffic (St Brelade) (Amendment No. 15) (Jersey) Order 2007, to become effective 14 days after it is made, the purpose of which is to improve traffic management in the Parish by:

1. Prohibiting commercial vehicles from waiting on Le Chemin des Pietons

2. Prohibiting waiting on a section of Le Chemin des Pietons

3. Extending the current prohibition of waiting on Le Mont es Croix

4. Scheduling the current prohibition of waiting on La Route de la Baie

5. Prohibiting waiting outside of “Peterborough Garage” on La Neuve Route

TRANSPORT AND TECHNICAL SERVICES  

ROAD TRAFFIC (ST BRELADE) (JERSEY) ORDER 1990 – AMENDMENTS.                                                                                                                                                                                                                                                                                                                                                               

Purpose of the report  

To improve the traffic management on five roads in the Parish of St Brelade. 

Background  

The Connetable of St Brelade has written to the Department requesting the Minister for Transport and Technical Services to amend the Parish Road Traffic Order with regard to:- 

  1. Prohibiting commercial vehicles from waiting on Le Chemin des Pietons.
  2. Prohibit waiting on a section of Le Chemin des Pietons.
  3. Extend the current prohibition of waiting on Le Mont es Croix.
  4. Schedule the current prohibition of waiting lines on La Route de la Baie.
  5. Prohibit waiting outside of “Peterborough Garage” on La Neuve Route.

 

Discussion 

  1. The Parish has requested that all commercial vehicles be prohibited from waiting on Le Chemin des Pietons as a result of residents of the road experiencing difficulties accessing their properties due to large, and medium sized commercial vehicles being parked in this narrow parish road during the evenings and weekends. The Parish have also observed commercial vehicles of all classes being parked in the road for long periods of time by non residents of the immediate area, thus denying the residents of the area, and visitors to the amenities of St Aubin, from parking their private vehicles in this road.

 

  1. The Parish have also requested that the section of Le Chemin des Pietons opposite the property “Valentine Cottage” be subject to prohibition of waiting for all classes of vehicle, to allow the owners of the property to access their parking space.

 

  1. The Parish has requested that the current prohibition of waiting on Le Mont es Croix be extended on its eastern side, towards La Route de la Baie, to allow vehicular access to the church car park.

 

  1. For many years yellow prohibition of waiting lines have been painted on both sides of La Route de la Baie, for its entire length. However the Parish has noted that the prohibition of waiting is not scheduled in the Road Traffic (St Brelade) (Jersey) Order 1990. The Connetable therefore requests that the prohibition of waiting restriction be included in the above Order.

 

  1. The request for prohibition of waiting between the two entrances of “Peterborough Garage” on La Neuve Route, is to ensure good visibility to patrons of the Garage when entering and exiting the property.

 
 

The Minister is requested to approve the attached Draft Road Traffic (St Brelade) (Amendment No. 15) (Jersey) Order 2007, with regard to the above items, to be included in the Road Traffic (St Brelade) (Jersey) Order 1990.

Recommendation

 

The Minister is requested to approve the Amendment to be effective from two weeks after the Order is made.

To improve the traffic management on Le Chemin des Pietons, Le Mont es Croix, La Route de la Baie, and La Neuve Route.

Action Required 

The Minister to instruct his officers to process the Ministerial Decision.
