Island Plan 2011: Interim Review: Appointment of Inspectors and Terms of Reference

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

2011 Island Plan interim review: Inspector’s terms of reference

Oral Rapporteur:

Decision(s):

The Minister for Planning and Environment

  1. approved the appointment of Mr Chris Shepley, as inspector, and Mr Alan Langton, as assistant inspector, to conduct an Examination in Public in relation to the Minister’s proposed revision of the 2011 Island Plan;
  2. approved the appointment of Mrs Helen Wilson, as programme officer, to provide administrative support to the inspectors;
  3. approved terms of reference for the inspectors.

Reason(s) for Decision:

The appointment of Mr Chris Shepley and Mr Alan Langton as inspectors is considered to represent best value and optimum efficiency on the basis that both were engaged as inspectors for the 2011 Island Plan Review and are already familiar with the issues related to the proposed revision of the Plan;

The appointment of Mrs Helen Wilson is considered to represent best value and optimum efficiency on the basis that she was engaged as programme officer for the 2011 Island Plan Review and is already familiar with the administration of an EiP in Jersey;

The quality of their work, involving the management and facilitation of the examination process; the engagement of participants; and the distillation and dissemination of often considerable volumes and complex argument of evidence in the form of an accessible and concise output is considered to be exemplary;

The Minister is required to set and publish terms of reference for the inspectors before the closing date for initial representations.

Legal and Resource Implications:

The appointment of the inspector, assistant inspector and programme officer accords with the provisions of the Planning and Building (Island Plan)(Jersey) Order 2009;

Provision has been made within the Environment Department’s 2013 budget, to meet the costs of an EiP, including the appointment of inspectors and administrative support. The extent of cost is, however, dependent upon the number of representations made and further provision is available within the Treasury Department, as approved by the States, in respect of the requirement to review the Island Plan, as necessary.

Action required:

Conclude formal engagement of the inspectors and the programme officer;

Publish the terms of reference for the inspectors
