Road Traffic (St. Brelade) (Jersey) Order 1990: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST BRELADE) (JERSEY) ORDER 1990 - AMENDMENT REQUEST

 

 

Purpose of the Report

 

To request the Minister for Infrastructure to amend the Road Traffic (St Brelade) (Jersey) Order 1990.

 

 

Background

 

The Constable for St Brelade has requested several changes to the Road Traffic (St Brelade) (Jersey) Order 1990.

 

The Constable wishes to prohibit waiting across various locations in the Parish to discourage dangerous and problematic parking.

 

The Constable would also like to introduce a 12 hr time limit to parked vehicles in several locations, as these locations are often abused by motorists leaving their vehicles for prolonged amounts of time, preventing use by local residents.

 

The Parish has also requested to restrict the width and weight of vehicles using Mont de la Rocque following a structural survey of the road recommending that large vehicles be prevented from using this road.

Schedule 2 - Prohibition of Waiting

 

Le Boulevard

  • To remove the yellow prohibition line to the West of the Assembly rooms (the old Gallichan Marine). This requires no change to the Order, just an on street change to markings.

 

St Brelade Slipway Access Road

  • East side from its junction with La Route de la Baie. To add this to the Order as it is not currently listed.

 

Belle Vue

  • From its junction with Vue des Mielles Belle Vue to a point 26 yards further west.

 

La Rue Voisin -

  • West side (from a point 80 yards South of its junction with Le Chemin du Portelet to a point 150 yards south of its junction with Le Chemin du Portlet.
  • West side (from a point 198 yards South of its junction with Le Chemin du Portelet to a point 256 yards south of its junction with Le Chemin du Portelet.

 

La Route de Noirmont –

  • West side from a point 37 yards North of Travers Farm Lane to a point 119 yards further North.
  • East side from its junction with Travers Farm Lane to a point 123 yards further North.

Mont de la Rocque

  • From its junction with Le Mont Au Roux for its entire length.

La Montee Du Sud Access Road

  • East side - from its junction with La Route de la Pulente to its southern boundary with La Montee du Sud.

 

La Rue Voisin:

  • From its junction with le Chemin de Portelet to a point 80 yards further south
  • From a point 150 yards south of its junction with Le Chemin de Portelet to a point 48 yards further south.

 

St Brelade Slipway Access Road

  • The marked parking bays on the East side from its junction with La Route de la Baie to the slip way.

 

Le Clos des Sables Car Park

  • The car park that is accessed immediately to the west of the property known as No 161 Les Quennevais Park on Le Clos des Sables.

 

 

Recommendation

 

The Minister is recommended to approve the request.
