Head of Customs and Immigration

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

Reason(s) for decision:

Article 4 of the Customs and Excise (Jersey) Law 1999 requires the States to make the decision in respect of an appointment to the post of Agent of the Impôts.

PROPOSITION

THE STATES are asked to decide whether they are of opinion -

In accordance with Article 4 of the Customs and Excise (Jersey) Law 1999, to appoint Mr Michael Robinson as Agent of the Impôts with effect from 1st March 2006.

REPORT

1. Acting in my capacity as Minister for Home Affairs, I am pleased to propose the appointment of Mr Michael Robinson to the position of Head of Customs and Immigration.

2. The process for the recruitment of the Head of Customs and Immigration has been managed by the States Human Resources Department with the full involvement of the Appointments Commission. The Appointments Commission agreed that the post should be advertised internally within the States of Jersey. The Selection Board comprised Advocate Rose Colley - Appointments Commission, Steven Austin-Vautier - Chief Officer, Home Affairs Department, Ian Crich - Director of Human Resources and Brian Richings - Chief Officer, Home Department - States of Guernsey.

3. Following a rigorous interview and assessment process, the unanimous decision of the Selection Board was to recommend the appointment of Michael Robinson as the Head of Customs and Immigration. Michael Robinson is currently Director of Customs and Excise, States of Jersey, and has substantial experience of Customs and Excise gained during a 30 years career within the Department.

4. Whilst the Home Affairs Department has the authority to appoint Mr Robinson to the post of Chief Officer of Immigration, the States must make the decision in respect of the appointment to Agent of the Impôts, in accordance with Article 4 of the Customs and Excise (Jersey) Law 1999.

5. This post falls vacant on 1 March 2006 with the retirement of Steve Cole on 28 February 2006. There are no further manpower or financial implications for the States arising from this appointment.
