Beau Rivage Hotel, Route de la Baie, St. Brelade - serving of enforcement notice

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s

To serve an enforcement notice upon the owner, Mr Robert Weston, and the company Beau Rivage Hotel Limited requiring that the remedial works highlighted under retrospective building application R/2007/0014 are carried out to achieve compliance with Building Bye-Laws (Jersey) 2004 by the 30th June 2007.

Reason(s) for decision:

To gain compliance of the Beau Rivage Hotel with Building Bye-Laws (Jersey) 2004 as soon as possible following unauthorised internal alterations.

Enforcement notice to be served.

1. THIS IS A FORMAL NOTICE issued by the Minister for Planning and Environment ("the Minister") pursuant to the powers conferred on him by Article 40(2) of the Planning and Building (Jersey) Law 2002;

2. The Minister, having considered the retrospective building application received on 8 January 2007 and registered under the number R/2007/0014, in relation to the unauthorised internal alterations carried out at the Beau Rivage Hotel in the Parish of St Brelade has decided that the work carried out breaches requirements 4,5,6, (Fire Safety) 28 and 29 (Resistance to the Transmission of Sound) of the second schedule to the building bye-laws (Jersey) 2001, those being the bye-laws in force at the time the work was done.

3. THE MINISTER HEREBY GIVES YOU NOTICE TO CARRY OUT THE FOLLOWING WORK:

All remedial works specified on the following drawings, which are enclosed with this notice:

766/13a Third floor plan.

766/14a Sections / Details.

766/15 Ground floor plan

766/16 Specification.

4. THE LAND AFFECTED: Beau Rivage Hotel

5. THE ABOVE WORK MUST BE CARRIED OUT BEFORE THE 31 AUGUST 2007.

6. WHAT WILL HAPPEN IF THIS NOTICE IS NOT COMPLIED WITH:

In accordance with Article 44 (1) of the aforesaid Law, papers will be dispatched to the Law Officers’ Department for the purpose of prosecution for breach of this notice.

7. WHAT YOUR RIGHTS ARE: In accordance with Article 117 of the aforesaid Law, you may appeal to the Royal Court, within 28 days of the service of the notice.
