Public Employees Contributory Retirement Scheme (PECRS) and Jersey Teachers' Superannuation Fund (JTSF): Chairman: Appointment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Appointment of Chairman of both the Public Employees Contributory Retirement Scheme (PECRS) and the Jersey Teachers’ Superannuation Fund (JTSF).

 

Decision(s):

The Minister decided to -

  1. Recommend to the States Assembly the appointment of Mr Gordon Pollock as the Chairman the Public Employees Contributory Retirement Scheme (PECRS).
  2. recommend to the Chief Minister the appointment of Mr Gordon Pollock as the Chairman the Jersey Teachers’ Superannuation Fund (JTSF).

 

Reason(s) for Decision:  

The current Chairman of both the Committee of Management of the PECRS and the Management Board of the JTSF, Mr Ron Amy, OBE, will be stepping down at the end of June 2014.   

 

The Chairman of the Committee of Management (CoM) of the PECRS is appointed by the States on the recommendation of the Minister for Treasury and Resources. Any such recommendation shall be supported by a majority of the member representatives and a majority of the employer representatives of the CoM.  This recommendation was supported by the CoM representatives at the PECRS meeting held on 26 March 2014.

 

The Chairman of the Management Board (MB) of the JTSF shall be appointed by the Chief Minister on the recommendation of the Minister for Treasury and Resources. This recommendation may only be made if it is supported by at least 3 of the member representatives and at least 3 of the employer representatives. This recommendation was supported by the MB representatives at the JTSF meeting held on 25 March 2014.

 

Resource Implications:

None.

 

Action required:

The Greffier of the States to be requested to arrange for the attached Report and Proposition to be lodged at the earliest opportunity. A Ministerial Decision prepared for the Chief Minister’s signature in order to appoint Mr Gordon Pollock as Chairman of the JTSF Management Board for a 5 years period from 1 July 2014.
