A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): To agree a budget transfer in the sum of £2,000 to the Chief Ministers Department in order to fund the continued collation of statistical data for the Education, Sport and Culture Department.
Reason(s) for decision: In accordance with a decision of the Corporate Management Board dated 14th June 2006 in order for the Statistics Unit of the Chief Ministers Department to continue the collation of statistical data on behalf of States Departments.
Action required: Assistant Director – Finance to request the Treasurer of the States to action this as a non-contentious transfer between departments in accordance with Financial Direction No.3.6 Variations to Heads of Expenditure and to inform the Treasury of the appropriate code from which the budget will be transferred.

1. Introduction

The purpose of this paper is to outline the background and agree a budget transfer as agreed at a meeting of the Corporate Management Board in 2006 to fund the continued work of the Statistics Unit of the Chief Ministers Department

2. Background

At its meeting of the 14th June 2006, the Corporate Management Board, agreed with a method of funding the work of the Statistics Unit of the Chief Ministers Department on the basis of an apportionment to States Departments as follows:-

The minutes of that meeting are as follows:-

‘The Board noted that over the last two years the Statistics Unit had worked to develop new sources of social data. By undertaking this work on an in-house basis, the Unit had been able to make considerable savings, but there was still a requirement for additional funding to ensure the continuation of the service. The minimum cost of providing this service was £40,000 year, and it was proposed that this should be funded by budget transfers from other departments. The transfer sums for each department would be calculated by referring to the costs applied to these departments during the first two years of the Jersey Annual Social Survey’.

3. Recommendation

To agree a budget transfer in the sum of £2,000 to the Chief Ministers Department in order to fund the continued collation of statistical data for the Education, Sport and Culture Department.
