A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Economic Development (EDD) request the use of additional Ofcom income and change of use of the carry forward currently allocated to the Jersey Aircraft Registry online registration to be used for onward additional grant, in 2015, to Digital Jersey Limited.
Officer recommendation: The Minister is recommended to approve the use of additional unanticipated income of £248,282 Ofcom income from 2014 to be added to the Economic Development Department’s approved revenue expenditure and recognised as income for 2015 and to approve the change of use of carry forward budget of £110,000 for the Jersey Aircraft Registry online registration to be used for an onward additional grant to Digital Jersey Limited.
Decision(s): The Minister approved the use of additional unanticipated income of £248,282 Ofcom income to be added to the Economic Development Department’s approved revenue expenditure and recognised as income for 2015. The Minister also approved the change of use of carry forward budget of £110,000 for the Jersey Aircraft Registry online registration to be used for an onward additional grant to Digital Jersey Limited.
Reason(s) for Decision: Under Article 19(1) of the Public Finances (Jersey) Law 2005 the Minister for Treasury and Resources can authorise a States funded body to withdraw from the consolidated fund during a year an amount not exceeding the likely excess of income over the amount approved in that year’s revenue allocation. Article 18(3A) of the Public Finances (Jersey) Law 2005 states the Minister may approve the withdrawal from the consolidated fund, after the end of the relevant financial year, of all or part of the amount appropriated by a revenue head of expenditure.
Resource Implications: Use of £248,282 additional income in 2015 to be added to the approved EDD revenue head of expenditure together with the change of use of carry forward budget of £110,000 for the Jersey Aircraft Registry online registration to be put toward an onward additional grant of £400,000 to Digital Jersey Limited. The balance will be taken from a recharge to the Jersey Innovation Fund of £41,718 for costs incurred for administration.
Action required: Head of Decision Support to inform the EDD Senior Management Accountant, Finance Manager - Corporate Group and the Financial Performance Reporting Manager that this decision has been approved.
